What we collect, how we use it, and the choices you control.

1. Who We Are

This Privacy Policy describes how Forwardfy Capital LLC ("we," "us," "our") collects, uses, and shares information when you visit our website, submit an application or inquiry, or otherwise interact with our services.

2. Information We Collect

  • Information you provide: name, contact details, business information, funding needs, and documents you submit (such as bank statements via the Secure Data Upload Center).
  • Information from third parties: with your consent, verification data from banks, financial institutions, and credit reporting agencies used to evaluate applications.
  • Automatic information: device and usage data (such as browser type, pages viewed, and referring page) collected through cookies and similar technologies to analyze website traffic and optimize your experience; and, if you arrive from an online ad or search result, advertising identifiers (such as UTM parameters, a Google Click ID, or a Meta Click ID) that we associate with the contact information you submit on that page so we can measure which ads led to your inquiry.
  • Electronic-signing records: when you complete and electronically sign an application or document, we record a tamper-evident audit trail of each action (for example, when the document was opened, viewed, and signed), including the date and time, your IP address, and your approximate location (city, region, and country) derived from network signals. We keep this information to verify your electronic signature, prevent fraud, and meet our legal record-keeping obligations for electronically signed records.
  • Saved application progress: if you start our online funding application but do not finish it, your non-identifying answers (such as funding amount, purpose, industry, and revenue range) are saved temporarily in your browser's local storage so you can resume on the same device; we do not save your name, email, phone number, or business name this way. This saved copy is cleared when you submit the application, and saved answers more than 7 days old are discarded the next time the application page is opened on that device.

3. How We Use Information

  • To evaluate applications and provide funding products and services;
  • To communicate with you about applications, offers, and services (see Section 5);
  • To verify identity, prevent fraud, and meet legal and regulatory obligations;
  • To operate, analyze, and improve our website and services.

4. How We Share Information

We share the information described in Section 2 as needed to evaluate your application and connect you with financing options. This may include:

  • your contact information, business information, and submitted financial documents (such as bank statements) with third-party small-business funding partners so they can evaluate and, if appropriate, offer you financing;
  • verification information with banks, financial institutions, and credit reporting agencies for identity verification and underwriting, which may include a business and/or personal credit check as described in our Terms and Conditions;
  • information with service providers who help us operate our website, process applications, and communicate with you, including a workflow-automation service provider that receives your website form submissions and routes them to our team. Service providers act on our behalf and under our instructions, and are not permitted to use your information for their own marketing;
  • usage information — pages viewed, approximate location derived from IP address, and similar device identifiers set by cookies — with our website analytics provider, Google Analytics 4, so we can measure how visitors find and use this website. This policy, our Terms and Conditions, and our Disclosures are excluded from that measurement; and
  • information as required by law, regulation, or legal process.

Text messaging opt-in data is excluded from all of the above. All categories of data listed in this section exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. See Section 5.

5. Communications and SMS

With your consent, we and our designated agents may contact you by phone and email, including by automated technology, artificial or prerecorded voice, or AI-generated messages. Our designated agents act on our behalf and under our instructions, and are not permitted to use your information for their own marketing. You can opt out of emails via the unsubscribe link, or by writing to Info@ForwardFy.com.

Text messages are for existing customers only. Forwardfy Capital LLC uses its text messaging program to coordinate with existing customers who have opted in to account notifications via SMS. We do not send marketing text messages, and we do not text website visitors, prospects, or applicants who have not become customers. There is no text-message sign-up anywhere on this website: opt-in is collected only on the signed funding application, and it is never a condition of applying for or receiving funding. Giving us your phone number is not consent to be texted.

When you opt in to receive text messages from Forwardfy Capital LLC, we collect your mobile phone number and your consent to be contacted. You may opt out of text messages at any time by replying STOP or UNSUBSCRIBE to any message, and you may reply HELP or INFO for assistance. To opt back in, text START or YES. All opt outs are handled immediately via our global stop list. Opting out of text messages will not affect any other services you receive from us. Message frequency varies based on your interactions with us, and message and data rates may apply.

Text messages are delivered on our behalf by our text messaging platform provider acting as our service provider. That provider processes this information solely to deliver the messaging service and does not use or share your mobile information for its own marketing purposes.

How this fits with Section 4. When you submit an application, the contact details you give us, which can include your phone number, go to funding partners for one purpose only: so they can evaluate the application you asked us to submit and respond to you about it. That is not marketing or promotional sharing, and it is limited to the application you submitted. Your SMS opt-in and consent records are never included, and no funding partner, affiliate, or other third party receives your mobile information to use for its own marketing or promotional purposes.

6. Cookies

We use cookies to analyze website traffic and optimize your website experience, including cookies set by Google Analytics 4 (see Section 4). You can control cookies through your browser settings; disabling them may affect site functionality. You can also opt out of Google Analytics measurement across websites using Google’s browser add-on at tools.google.com/dlpage/gaoptout. If a form submission cannot be delivered immediately (for example, due to a temporary connection issue), the information you submitted may be held in your browser's local storage and retried automatically; it is removed once the submission succeeds.

7. Data Security

We use administrative, technical, and physical safeguards, including encryption in transit for applications and document uploads, designed to protect your information. No method of transmission or storage is 100% secure; please use the Secure Data Upload Center rather than email for sensitive documents.

8. Data Retention

We retain information as long as needed for the purposes described above and to satisfy legal, accounting, and reporting requirements.

9. Your Choices and Rights

You may request access to, correction of, or deletion of your personal information, subject to legal limits, by contacting Info@ForwardFy.com or calling (855) 393-7449, Monday – Friday, 9:00 a.m. – 8:00 p.m. ET. Depending on your state of residence, you may have additional rights under applicable state privacy laws.

California residents: To the extent the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), applies to us, California residents have the right to know what personal information we have collected about them, to request deletion or correction of that information, to opt out of the “sale” or “sharing” of personal information (including for cross-context behavioral advertising), to limit the use of sensitive personal information, and not to receive discriminatory treatment for exercising these rights. You may submit a request using the contact information above. We use Google Analytics 4 to measure website traffic, as described in Sections 4 and 6. We do not currently use third-party advertising or retargeting pixels on this website, and we do not use the analytics information we collect to build profiles for cross-context behavioral advertising. If that changes, we will update this policy, post a “Do Not Sell or Share My Personal Information” link, and honor recognized opt-out preference signals, including Global Privacy Control (GPC), from browsers that send them.

10. Children

Our services are intended for business use by adults. We do not knowingly collect information from children under 13.

11. Changes to This Policy

We may update this Policy from time to time. The "Last updated" date above reflects the latest revision.
