SMS Terms and Conditions

These SMS Terms & Conditions ("Terms") govern the text messaging (SMS/MMS) program operated by Forwardfy Capital LLC ("Forwardfy Capital," "we," "us," or "our"). By opting in to our messaging program, you agree to these Terms. For everything else, see our general Terms & Conditions.

1. Use of Services

You agree to use our services and communications only for lawful purposes and in accordance with these Terms. You are responsible for the accuracy of the information you provide to us, including the mobile phone number you use to opt in to text messages.

2. Program Description

Forwardfy Capital uses this campaign to coordinate with existing customers over SMS, who have opted in to account notifications via SMS. Opt-in is collected on the signed funding application only. There is no text-message sign-up on this website, and consenting to texts is never a condition of applying for, purchasing, or obtaining any product or service from Forwardfy Capital.

By opting in to text messages from Forwardfy Capital, you agree to receive recurring messages related to your account, which may include account updates, appointment or document notifications, funding and payment notifications, customer-care responses, and other service-related communications. The specific message types you receive depend on the services you have requested. All messages from Forwardfy Capital are delivered by our text messaging platform provider, which delivers these messages on our behalf.

Forwardfy Capital: You’ve successfully opted in to receive text alerts. Message frequency may vary. Msg and data rates apply. Text HELP for assistance. Text STOP to unsubscribe.

All opt outs are handled immediately via our global stop list.

3. Message Frequency

Message frequency varies based on your interactions with us. If you contact us, we may reply with one or more messages per inquiry. You may also receive periodic service-related or confirmation messages.

4. Cost

Message and data rates may apply based on your mobile carrier's plan. Forwardfy Capital does not charge for the text messages themselves; any charges are determined by your wireless carrier.

5. How to Opt Out

You can cancel the SMS service at any time by texting STOP or UNSUBSCRIBE to the number from which you received messages. After you send STOP, we will send a one-time confirmation that you have been unsubscribed, and you will no longer receive messages from that program. All opt outs are handled immediately via our global stop list. To rejoin, text START or YES to that same number, or opt in again as you did originally.

7. Carriers and Delivery

Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your wireless carrier and is not guaranteed.

8. Privacy

Your privacy is important to us. For details on how we collect, use, and protect your information, including your mobile opt-in data, please see our SMS Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who support our services (such as customer service or message-delivery providers) is permitted solely to operate the messaging program on our behalf. All categories of data exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

9. Intellectual Property

All content, trademarks, and materials provided by Forwardfy Capital are owned by or licensed to us and are protected by applicable laws. You may not reproduce or use them without our prior written permission.

10. Disclaimer of Warranties

Our services and communications are provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, Forwardfy Capital will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or messaging program.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of our services or messaging program after any change indicates your acceptance of the updated Terms.
