1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the website operated by Forwardfy Capital LLC ("Forwardfy Capital," "we," "us," or "our"). By accessing the website, submitting an application, or making an inquiry, you ("the User") agree to be bound by these Terms and by our Privacy Policy.

Forwardfy Capital LLC is a direct funder of alternative business funding products, which may include revenue-based financing, merchant cash advances, invoice factoring, term loans, and lines of credit. Funding may be provided directly by Forwardfy Capital LLC or through one of our funding partners. Where a product is provided by a funding partner rather than by us, that provider is identified to you before you sign, and the credit decision, underwriting decision, and funding offer for that product are made by that provider. Forwardfy Capital LLC is not a bank, and its products are not consumer loans.

2. Authorization and Capacity

The User confirms that they possess the legal capacity to use this website and to enter into agreements, and that they are authorized to act on behalf of any business or entity they represent in any application, inquiry, or communication made through the website.

The User further represents that any financing sought through this website is for business or commercial purposes only, and not for personal, family, or household use.

3. Accuracy of Information

The User agrees to provide accurate and complete information when applying or making inquiries via the website, and to promptly update such information as needed. Submitting false or misleading information may result in denial of services and may carry legal consequences.

4. Credit Inquiries and Checks

By submitting an application, the User authorizes Forwardfy Capital LLC and the funding providers to which Forwardfy Capital LLC submits the User's application to contact third parties - including banks, financial institutions, and credit reporting agencies - to verify the information provided. Checking your initial funding options involves no hard credit check. Any credit check run at that stage is a soft credit pull, which does not affect your personal credit score. A funding provider may require a hard credit check, which could include business and/or personal credit reports, before issuing a final funding offer; Forwardfy Capital LLC will inform you before any such check that could affect your credit score, and any hard credit check will only be run with your permission.

5. Information Sharing and Confidentiality

The User consents to the collection and disclosure of personal information in accordance with our Privacy Policy. Forwardfy Capital LLC may share User information with third-party small-business funding partners, banks, financial institutions, and credit reporting agencies for the evaluation and offering of credit products and services suited to the User's business, and with service providers who help operate the website and process applications. Where that information includes the User's phone number, it is shared so the recipient can evaluate and respond to the User's application, not for the recipient's own marketing or promotional use. This sharing excludes text messaging originator opt-in data and consent, which is not shared with any third parties (see Section 7).

6. Communication Consent

When you submit a form on this website that includes a consent disclosure, you agree that Forwardfy Capital LLC and its designated agents and representatives may contact you by telephone, email, or other forms of communication regarding your application, our services, and related offerings, consistent with the specific consent language presented to you at the time you submitted your information. Text messages are not included in that: no form on this website collects text-message consent, and submitting a form or giving us a phone number never opts you in to texts. Text messaging is described in Section 7 and is limited to existing customers. Our designated agents and representatives act on our behalf and under our instructions, and are not permitted to use your information for their own marketing.

7. Text Messaging (SMS)

Existing customers only. Forwardfy Capital LLC uses its text messaging campaign to coordinate with existing customers over SMS, who have opted in to account notifications via SMS. We do not send marketing text messages, and we do not text prospects or applicants who have not become customers.

How opt-in works. No form on this website collects text-message consent. Opt-in is collected only on the signed funding application, it is optional there, and it is never a condition of applying for, purchasing, or obtaining any product or service from Forwardfy Capital LLC. If you do not opt in, we do not text you at all. Messages are delivered on our behalf by our text messaging platform provider.

What you receive. If you opt in, you agree to receive recurring messages related to your account, which may include account updates, appointment or document notifications, funding and payment notifications, customer-care responses, and other service-related communications. Message frequency varies based on your interactions with us.

Cost. Message and data rates may apply based on your mobile carrier's plan. Forwardfy Capital LLC does not charge for the text messages themselves; any charges are determined by your wireless carrier.

How to opt out. You can cancel the SMS service at any time by texting STOP or UNSUBSCRIBE to the number from which you received messages, or by providing written notice to Info@ForwardFy.com. After you send STOP, we will send a one-time confirmation that you have been unsubscribed, and you will no longer receive messages from that program. All opt outs are handled immediately via our global stop list. To rejoin, text START or YES to that same number, or opt in again as you did originally.

How to get help. If you are experiencing issues with the messaging program, reply HELP or INFO for assistance, or contact us at Info@ForwardFy.com or (855) 393-7449, Monday – Friday, 9:00 a.m. – 8:00 p.m. ET.

Carriers and delivery. Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your wireless carrier and is not guaranteed.

Privacy. For details on how we collect, use, and protect your information, including your mobile opt-in data, see our SMS Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors who support our services (such as customer service or message-delivery providers) is permitted solely to operate the messaging program on our behalf. All categories of data exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

8. Acceptable Use of the Website

The User agrees not to misuse the website, including but not limited to:

• Attempting unauthorized access to systems, accounts, or data;
• Distributing malware, viruses, or other harmful code;
• Transmitting spam or unsolicited communications through the platform;
• Infringing the intellectual property rights of Forwardfy Capital LLC or any third party;
• Engaging in any activity that disrupts or impairs the website or its services.

9. Intellectual Property

All content on this website - including text, graphics, logos, and design - is the property of Forwardfy Capital LLC or its licensors and is protected by applicable intellectual property laws. No content may be reproduced or distributed without prior written permission.

10. No Offer or Guarantee

Content on this website is provided for general information and does not constitute an offer, commitment, or guarantee of funding. All funding products are subject to application, review, and execution of a definitive funding agreement, whose terms control in the event of any conflict with website content.

11. Indemnification

The User agrees to indemnify, defend, and hold harmless Forwardfy Capital LLC, its officers, employees, and agents from and against any liability, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from the User's use of the website or violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
